By booking, enquiring about, or using any of our Services, you confirm that you have read and agree to these Terms and Conditions. If you do not agree, please do not proceed with using our Services.

Our Services are available to individuals aged 18 and above. By using the Services, you confirm that you have the legal capacity to enter into a binding agreement under Malaysian law.

Willowend provides general education about how estate matters are typically organised in Malaysia, and practical assistance with sorting and labelling personal records. Our Services are educational and organisational in nature only. We do not:

4. Service Booking and Delivery

Services are booked by contacting us via telephone, email, or our website contact form. A booking is confirmed when we send written confirmation to you.

Sessions are delivered at our office in Johor Bahru or, where mutually agreed, via video call. We will confirm the delivery format at the time of booking.

We endeavour to deliver Services within agreed timeframes. However, timelines may be affected by the volume and complexity of records involved, scheduling requirements, or other factors outside our control. We will communicate any significant changes to scheduling with reasonable notice.

5. Fees and Payment

Our fees are as follows, in Malaysian Ringgit (RM):

All fees are inclusive of materials within the scope of each service as described on our website. Payment methods and timing will be confirmed at the time of booking. Fees are quoted and payable in Malaysian Ringgit.

Cancellation and rescheduling: If you need to cancel or reschedule a session, please notify us as early as possible. Cancellations made with less than 48 hours' notice may incur a partial session fee. We will consider requests on a case-by-case basis and will always try to find a reasonable arrangement.

Refunds: If we are unable to deliver a confirmed Service, we will refund any fees paid for that Service. We do not offer refunds for completed sessions or materials already delivered. Partial refunds for partially completed programmes may be considered at our discretion.

All Content produced by Willowend — including printed materials, checklists, glossaries, folder systems, and educational handouts — remains the intellectual property of Willowend. We grant you a personal, non-exclusive, non-transferable licence to use Content for your own private, non-commercial purposes. You may not reproduce, distribute, or adapt our Content for any other purpose without our prior written permission.

Our Services and Content are provided for general educational and organisational purposes only. While we take care to ensure that information is accurate and relevant to the Malaysian context, we make no warranty, express or implied, that the information provided is complete, current, or applicable to your specific situation.

We are not liable for any decisions you make based on information obtained through our Services. All formal estate, legal, and financial decisions should be made in consultation with appropriately qualified and licensed professionals.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Willowend's total liability to you for any claim arising from or related to our Services shall not exceed the fees you have paid to us for the specific Service giving rise to the claim.

We shall not be liable for any indirect, consequential, incidental, or special loss or damage, including loss of data, income, or opportunity, arising from use of our Services, even if we have been advised of the possibility of such loss.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

You agree to indemnify and hold Willowend harmless from any claims, losses, liabilities, or expenses (including reasonable legal costs) arising from your misuse of our Services, your breach of these Terms, or any false or misleading information you provide to us.

11. Confidentiality

We treat all personal information and family details shared with us as confidential. We will not disclose information about your engagement with our Services to third parties except as required by law or as described in our Privacy Policy. We ask that you similarly treat any non-public information about our methods or materials as confidential.

12. Termination

Either party may terminate a service engagement by giving reasonable written notice. If you terminate a programme midway, fees for sessions and materials already delivered remain payable. We reserve the right to end an engagement if a user is abusive toward our team or misuses our Content.

Sections 6, 7, 8, 9, 10, and 13 of these Terms survive termination.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or related to these Terms or our Services shall first be addressed through good-faith direct discussion between the parties. If a resolution cannot be reached informally, disputes shall be subject to the jurisdiction of the courts of Johor Bahru, Malaysia.

14. General Provisions

These Terms, together with any service confirmation we provide, constitute the entire agreement between you and Willowend relating to the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign your rights under these Terms without our written consent.

15. Changes to These Terms

We may update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. Continued use of our Services after an update constitutes acceptance of the revised Terms. We recommend checking this page periodically.
